  • What should be included in the divorce financial settlement – all assets that the parties own jointly or in their sole name can be looked at and considered, such as (but not limited to) income, division of property, pensions, savings, and investments.
  • What happens if you cannot agree? – The Courts like to see that parties have attempted if it is possible (and this is not always, for example in domestic abuse cases) that you have attended mediation to try and compromise rather than head straight into court proceedings, which can be costly, stressful and time consuming. The court is not there to punish parties when they have decided to separate but they do encourage the parties to try and agree the issues between them.
  • What happens if we agree? – Great! Once you have obtained your legal advice and you have negotiated terms you can agree to, then you will be required to submit a draft consent order together with financial form D81 into the court for a Judge to review and hopefully (as subject to the court’s approval) make the paperwork binding by granting the court’s approval.
